GENERAL TERMS AND CONDITIONS OF TIME GOLD GmbH

1. SCOPE
These terms apply to all contracts between TIME GOLD GmbH, Gotthardstrasse 50, 8800 Thalwil ("TIME GOLD") and its customers, in the atelier and online (www.timegold.ch and www.time-gold.ch). Other arrangements apply only if confirmed in writing. Separate terms also apply to the "Gold as Investment" offer.
2. CONTRACT
Products shown on our websites are not a binding offer. A contract is formed when we confirm your order or commission by email or in writing, or when you pay in the atelier.
3. PRICES AND PAYMENT
All prices are in Swiss francs (CHF) and include Swiss VAT. Precious-metal prices may change with the daily rate; the price at the time of order confirmation applies. We accept the payment methods shown in the atelier and at checkout. Online orders ship once payment has been received.
4. BESPOKE WORK AND REDESIGNS
- The basis is the design or quote you have approved.
- A deposit of 50% is due when you place the commission.
- Once work has started, cancellation is only possible against payment for work done and materials used.
- Handmade pieces may differ slightly from the design in weight, size and colour.
- When redesigning your own jewellery, we reset existing stones to the best of our ability. We are liable for breakage of damaged or fragile stones only in case of gross negligence.
5. REPAIRS, CLEANING AND STORAGE
Estimates are non-binding; if costs exceed the estimate by more than 15%, we ask for your approval first. Finished work must be collected within 3 months of notice. After that we may charge a storage fee of CHF 10 per month. After 12 months and a written reminder, we may sell uncollected items to cover what is owed.
6. PURCHASE OF OLD GOLD AND PRECIOUS METALS
We buy only from adults with valid official ID. The seller confirms the items are their lawful property. The price depends on fineness, weight and the daily rate. We may decline a purchase without giving reasons and report suspicious cases to the authorities.
7. VALUATIONS AND REPORTS
We prepare valuations to the best of our knowledge for the stated purpose (e.g. insurance). They are not a guarantee of any purchase or sale price.
8. DELIVERY AND RISK
We ship within Switzerland and to selected international destinations, carefully packed. Risk passes to you on delivery. Report transport damage or a missing parcel within 48 hours of the (expected) delivery date. Customs duties and import taxes outside Switzerland are paid by the customer.
9. RETURNS
Swiss law grants no statutory right of withdrawal for online purchases. As a courtesy, we accept unworn items from the online shop within 15 days of receipt, in their original condition and packaging, after you request the return at info@timegold.ch. Excluded are bespoke, engraved, resized or altered pieces, and earrings for hygiene reasons. Customers in the EU keep any statutory right of withdrawal under their national law.
10. WARRANTY
We give a 2-year warranty on defects in material and workmanship from delivery. We remedy defects by repair or replacement, at our choice. Normal wear, improper handling, accidents and work by third parties are excluded. Pre-owned watches: 12 months.
11. WORKSHOPS AND MASTERCLASSES
Your place is confirmed on payment. Cancel up to 7 days before and we refund you; after that you may rebook but not get a refund.
12. LIABILITY
We are liable for intent and gross negligence. Liability for slight negligence and consequential damage is excluded where the law allows. Liability for items left with us is limited to their proven material or replacement value; we recommend insuring valuable pieces yourself.
13. DATA PROTECTION
Our Privacy Policy applies.
14. LAW AND JURISDICTION
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is Thalwil. Mandatory consumer jurisdictions remain reserved.
If the German and English versions differ, the German version prevails.
